New trademark law comes into force on 1st January 2011


On the 29th January 2010, the government handed over a proposal for a new trademark law to the Swedish Council on Legislation.

The main changes which this will entail are:

  • that processing of registrations will be clearer and the language more modern, which will promote effectiveness
  • that a trademark application can be partially rejected
  • that a trademark can be revoked through administrative routes by the Swedish Patent and Registration Office
  • the opposition period is extended to 3 months
  • that corporate regulations are coordinated as much as possible with trademark law
  • to allow Sweden to join the Singapore convention, the aim of which is to harmonise the formal requirements of trademark law.

According to the Minister for Justice, Beatrice Ask, a modernization of the trademark legal framework is desirable, inter alia to stimulate the establishment of new businesses in Sweden.
