Can "The South Butt" confused with "The North Face"?
Yes, definitely, "says the American outdoor company The North Face, who filed a lawsuit in U.S. District Court in St. Louis. "The South Butt are marketing apparel that directly and unabashedly infringes and dilutes The North Face's famous trademarks".
The South Butts slogan "Never stop relaxing" can be compared with The North Face "Never stop exploring."
The 18-year-old Jimmy Winkelmann, who started and runs The South Butt defends himself with the observation that the public generally can see the difference between a face and a butt, a statement which is underlined by results from a Facebook page where this ability is tested: http://apps.facebook.com/south-butt-challenge/
A disclaimer in The South Butts website http://www.thesouthbutt.com/ encourage the uncertain consumer, who has trouble distinguishing a face from a butt that in case of doubt buy a product from The North Face instead.
