It´s so easy

Following a ruling of The General Court in November 2011, one can draw the conclusion that it is not necessarily a disadvantage to add an explanatory note to a short and meaningless trademark, provided that this explanatory note is so insignificant that a consumer will not take it seriously.

The case at hand is an opposition against Community Trademark Application SE Sports Equipment (device) made by the holder of an earlier trademark SE So Easy.  The Court found that the average consumer would not necessarily look for an explanation of the word “SE”, meaningless to German consumers, in the other trademark elements ”Sports Equipment” or ”So Easy”.
